Terms of Service

1. Who you are agreeing with

Érudits is operated by Christine Myriam Tolefe, trading as Erudits Education, ABN 11 252 325 836, of Western Australia ("Érudits", "we", "us").

Contact: info@erudits.com

2. What Érudits is

Érudits is an online French practice platform for Years 7 to 12. Each year level contains forty weeks of material. A week typically includes vocabulary, an explicit grammar explanation, a reading passage, a listening dialogue, a writing task with a model answer, and speaking prompts with a recording tool. Years 11 and 12 also include an ATAR oral examination rehearsal.

Érudits is a practice and revision resource. It is not a teacher, a course of study, or a substitute for classroom instruction.

3. Who this agreement is between

This agreement is between Érudits and the school, not with individual teachers or students. The person who registers the school confirms they are authorised to enter into it on the school's behalf.

Teachers and students use the platform under the school's subscription.

4. Subscription and fees

Price. $25 per student, per year, in Australian dollars. Flat — no tiers, no per-year-level pricing, no setup fee.

GST. Érudits is not currently registered for GST, so no GST is charged and our invoices are not tax invoices. If that changes, we will tell you before your next renewal. Amounts already invoiced will not change.

Headcount. The fee is based on the number of students the school expects to give access to, as stated at registration. We do not meter or cap logins, and nothing in the platform blocks a student from logging in. If actual usage runs materially above the invoiced headcount we will raise it with you at renewal rather than mid-year.

Invoicing. We invoice the school directly. Payment terms are 30 days from the invoice date unless your school's own terms require otherwise and we have agreed to them in writing.

Term. A subscription runs for twelve months from the date we activate your teacher logins.

Activation. We create teacher logins before your access start date, which for most schools is the beginning of the academic year. Your twelve months run from that date, not from the date the invoice is paid.

Available material. The year groups the school has subscribed for are available in full from activation. A student’s login opens their own year level; a teacher login opens all six.

Renewal. Subscriptions do not renew automatically. We will contact you before the end of your term. If you do nothing, access simply ends.

5. Refunds

Two complete sample weeks — one Year 7, one Year 12 ATAR — are available at no cost and with no login, so that a school can evaluate Érudits fully before committing.

Because of this, the annual subscription fee is not refundable once the invoice has been paid, except where the Australian Consumer Law requires otherwise (see clause 13).

If something goes materially wrong on our side — a prolonged outage, or the platform not doing what we said it would — clauses 10 and 13 apply, and we will work out a fair remedy with you.

6. What the school and its teachers may do

While the subscription is active:

  • Every teacher in your French department may have a login.
  • Teachers may use any of the forty weeks, in any order, with their classes.
  • Teachers may display Érudits material on a screen while teaching a class whose students have their own logins.
  • Students at your school may use the platform for their own study.

7. What you may not do

Érudits material stays on the Érudits platform. You may not:

  • Take Érudits material off the platform — copy, download, export, print or otherwise reproduce it, in whole or in part.
  • Share teacher logins or student codes with anyone outside your school.
  • Sell, sub-licence, publish or redistribute Érudits material, in any format.
  • Upload Érudits material to a website, a shared drive, a resource-sharing site, or any similar service.
  • Use Érudits material to build a competing product, or supply it to any system that trains or fine-tunes an artificial-intelligence model.
  • Remove or obscure Érudits branding or copyright notices.

Érudits is licensed per student. It may not be used as a whole-class resource in place of student access — a class taught from one teacher login, with no student logins, is not permitted.

The licence ends when the subscription ends.

If your school has a particular need to use material away from the platform — a class without devices, or a site with poor bandwidth — ask us. We will usually agree in writing.

8. Intellectual property

All Érudits content — text, tasks, audio, model answers, grammar explanations, the CERCLE™ framework and the Érudits name and branding — remains our property. The school receives a licence to use it for the term of the subscription. Nothing transfers ownership.

9. Student accounts

Students log in with a short code that the school generates and hands out. Students do not provide an email address and do not set a password.

The school is responsible for:

  • Deciding which students receive codes.
  • Distributing codes to those students.
  • Telling us if a student leaves, so their access can be removed.

We do not contact students. We send no email to students at any time.

10. Availability

We will make reasonable efforts to keep Érudits available and working. We do not guarantee uninterrupted access. The platform may be unavailable during maintenance, or because of failures at our hosting providers or your own network.

We do not offer a service-level agreement or availability credits. If there is an outage of more than a few days that materially affects your use, contact us and we will work out a fair remedy with you.

11. Changes to the platform

We improve Érudits continually. We may add, change or remove features. We will not materially reduce what your subscription provides during a term that you have paid for.

Syllabus changes. The WA SCSA French ATAR syllabuses change for Year 11 in 2028 and Year 12 in 2029. Material rebuilt for a new syllabus is included in an active subscription at no extra charge, and will be available before the new syllabus takes effect.

12. Curriculum alignment

Érudits material is written against the Western Australian Curriculum: Languages (French) for Years 7 to 10, and the SCSA French: Second Language ATAR syllabuses for Years 11 and 12.

Érudits is not affiliated with, endorsed by, or approved by the School Curriculum and Standards Authority or the Department of Education. References to the syllabus describe what our material is mapped to, nothing more.

Teachers remain responsible for their own programs and for exercising professional judgement about what suits their students.

13. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

Where we are permitted to limit our liability, our total liability to you for any claim arising out of this agreement is limited to the amount the school has paid us in the twelve months before the claim.

We are not liable for indirect or consequential loss, including loss of profits, loss of data, or loss of opportunity.

14. Suspension and termination

We may suspend or end access if the invoice remains unpaid well past its due date, or if the school or its users breach clause 7. Where it is reasonable to do so, we will contact you first and give you a chance to put it right.

The school may stop using Érudits at any time. Fees already paid are handled under clause 5.

15. Your data

How we handle school, teacher and student information is set out in the Érudits Privacy Policy, which forms part of these terms.

16. Changes to these terms

We may update these terms. If a change materially affects a school with an active subscription, we will tell the school's contact by email, and the change will not take effect for that school until its next renewal.

17. Governing law

These terms are governed by the laws of Western Australia. The courts of Western Australia have jurisdiction.
